最近，有關(guān)演員王祖藍(lán)cospaly葫蘆娃被判侵權(quán)的話題沖上熱搜，引發(fā)網(wǎng)友們的關(guān)注。



本周一，北京互聯(lián)網(wǎng)法院公布了一份跟動(dòng)畫作品《葫蘆兄弟》版權(quán)相關(guān)的民事判決書。

The Beijing Internet Court's ruling in a case involving popular 1986 cartoon movie Calabash Brothers was made public on Tuesday.

判決書中顯示，原告上海美術(shù)電影制片廠有限公司認(rèn)為，在安徽廣播電視臺(tái)衛(wèi)視頻道于2016年3月播出了與北京世熙傳媒文化有限公司聯(lián)合出品的節(jié)目，其中就有以葫蘆娃形象出現(xiàn)的歌手、舞者，包括其節(jié)目名稱《葫蘆娃王祖藍(lán)變爺爺魔性表演飆音》侵權(quán)。

In a television program produced jointly by the Anhui Broadcasting Corporation and 3C Media, and broadcast in March 2016, some dancers had dressed like the characters in the movie while dancing to a song from the movie. Even the name of the program, "Calabash brother Wong Cho Lam changed his voice", raised eyebrows and Hong Kong actor Wong Cho Lam was cast in the show. 
 


 
判決書中顯示，根據(jù)相關(guān)法律規(guī)定，判定安徽廣播電視臺(tái)與北京世熙傳媒文化有限公司賠償原告損失。
 


可以看到，判決書中的原告、被告均非王祖藍(lán)。不過，網(wǎng)絡(luò)上卻出現(xiàn)了很多以“王祖藍(lán)cos侵權(quán)”等類似內(nèi)容為標(biāo)題的文章。

 

本周三，王祖藍(lán)工作室發(fā)布聲明，稱演員本人從未在安徽衛(wèi)視該節(jié)目中出現(xiàn)過葫蘆娃的裝扮，部分社交媒體使用的圖片“張冠李戴”。

On Wednesday, Wong's studio came to his defense saying Wong did not play any character from the movie in the show and some on social networking sites had used wrong pictures in their reports.
 


另據(jù)微博娛樂報(bào)道，王祖藍(lán)曾在另一檔湖南衛(wèi)視的節(jié)目中以葫蘆娃扮相出現(xiàn)過，安徽衛(wèi)視節(jié)目中出現(xiàn)的“視頻資料”圖片，有可能來自這一檔節(jié)目。而該節(jié)目也曾被上海美術(shù)電影制片廠告上法庭。
 


判決公布后，隨即引發(fā)網(wǎng)友熱議。

中國日?qǐng)?bào)網(wǎng)報(bào)道指出，還有些網(wǎng)友認(rèn)為，嚴(yán)格的版權(quán)條款可能會(huì)有損互聯(lián)網(wǎng)環(huán)境發(fā)展，但是另一方面，也會(huì)鼓勵(lì)更多原創(chuàng)內(nèi)容。復(fù)制粘貼內(nèi)容者就應(yīng)該向原作者支付版權(quán)，這樣也會(huì)鼓勵(lì)原作者制作更加優(yōu)良的內(nèi)容。

Some argue that having strict copyright rules might harm the development of the internet. On the contrary, it will encourage people to create more original content. And those who must copy and paste content, would do well to pay the copyright owner, who will then be motivated to create even better content.

報(bào)道還指出，也有網(wǎng)友擔(dān)心更加嚴(yán)格的版權(quán)法規(guī)會(huì)讓人一不小心就觸犯法律。不過，實(shí)際上只有那些靠抄襲獲利的人才會(huì)違法。在非商業(yè)獲利的前提下，大家自然還是能去扮演一把葫蘆兄弟的。

Many also worry that stricter copyright laws could mean people getting caught for the minutest of violations. However, such fears are uncalled for as only those who make profit by copying content will be treated as violators. People can still dress up as one of the Calabash Brothers－so long as they don't make money from it.
