把“女生內(nèi)在因素”認為是性侵害產(chǎn)生的因素？最近，中國美術(shù)學院下發(fā)的《新生安全知識手冊》里這一段內(nèi)容在互聯(lián)網(wǎng)上引發(fā)了極大的爭議。

A fine arts college in the eastern Chinese city of Hangzhou has drawn ire for publishing a “freshmen safety knowledge handbook” that attributes campus sexual violence to the “internal characteristics of women,” The Paper reported.



從微博流傳的手冊截圖中可以看到，手冊把“性侵害產(chǎn)生的因素”分成了3部分，包括“女生自身的內(nèi)在因素”、“易發(fā)生性侵害的時間和季節(jié)”以及“易發(fā)生性侵害的地點”。

The handbook, distributed by China Academy of Art, lists over half a dozen potential causes of sexual misconduct, according to screenshots of a chapter shared on microblogging platform Weibo. 

其中，在“女生自身的內(nèi)在因素”中羅列了“注重打扮，一味追求物質(zhì)享受”、“ 長相漂亮，處事輕浮”、“意志薄弱、難拒誘惑”等事項。

The chapter titled “Factors That Cause Sexual Assault” names “focusing too much on dressing,” “indulging in consumerism,” “being pretty and frivolous,” and “being unable to resist temptation” as contributing toward such incidents.



該手冊經(jīng)過微博曝光后，立刻在網(wǎng)上引起一片嘩然。

網(wǎng)友認為，手冊上把性侵害的一部分因素歸咎于 “女性自身”，但卻偏偏沒有談及施害者方面。





據(jù)澎湃新聞報道，中國美術(shù)學院保衛(wèi)處相關(guān)負責人回應(yīng)稱，該手冊系中國美術(shù)學院校園安全處編寫，是在處理相關(guān)案子過程中總結(jié)出來的，并不是歧視女性，在編寫過程中可能考慮不足。

Responding to the outcry, China Academy of Art said that the handbook, written by the school’s campus safety department, was derived from the firsthand experiences of sexual assault victims and does not “discriminate against women.” 

同時，相關(guān)人員在接受《瀟湘晨報》采訪時表示該手冊學生人手一本，爆料的學生只截取了一部分，有點斷章取義的味道。校宣傳部已經(jīng)注意到此輿情，會統(tǒng)一回應(yīng)。

不過，對于“斷章取義”的說明，微博評論顯示并不認可：




也有網(wǎng)友注意到，在“性侵害產(chǎn)生的因素”這一條目的后兩條，關(guān)于性侵害的預(yù)防和應(yīng)對舉措上，該手冊給出了如下建議：假期盡量不獨自一人留在寢室；夜間走大路；學會必要的近身搏斗；學會留痕跡取證；學會識別不法分子的體貌特征和拒絕“私了”等等。




另有網(wǎng)友指出，這本手冊內(nèi)容來自于浙江省高等教育學會高校保衛(wèi)分會組織編寫的普通高等院校安全教育教材《大學生安全知識讀本》（第十版）。




據(jù)CGTN報道，浙江省高等教育學會高校保衛(wèi)分會秘書長楊嘯銘回應(yīng)稱，審核中發(fā)現(xiàn)一些表述確實不夠嚴謹，明年修訂時會修改。

Yang Xiaoming, with Zhejiang Association of Higher Education, on Friday said that the manual by the Chinese Academy of Art had used “imprecise expressions” and noted that modifications will be made for next year.

A university in southern China’s Guangxi Zhuang Autonomous Region has been slammed for publishing a “safety handbook for women” that advised female students to adhere to certain dress etiquette. In the handbook, Guangxi University had a 50-item list of advice for first-year students as part of its safety education. It covered a range of topics, from safety tips on and off campus and suggestions on handling sexual harassment to requests that female students avoid wearing certain articles of clothing — skirts, low-cut dresses, and high heels — in order to “avoid temptation.”



對此，中國婦女報在官方微博發(fā)文指出：沒有任何犯罪學的依據(jù)實證兩者有必然關(guān)系。可以明確的倒是：被侵犯不是女孩子自身的問題，而是違法犯罪分子的問題。

1. 新出臺的《民法典》第1010條規(guī)定，違背他人意愿，以言語、文字、圖像、肢體行為等方式對他人實施性騷擾的，受害人有權(quán)依法請求行為人承擔民事責任。機關(guān)、企業(yè)、學校等單位應(yīng)當采取合理的預(yù)防、受理投訴、調(diào)查處置等措施，防止和制止利用職權(quán)、從屬關(guān)系等實施性騷擾。

Article 1,010 of the new Civil Code says a person may be held liable "for speech, words, images or bodily actions that have been used to carry out sexual harassment against a person's wishes."

2. 近日，國家一級演員田蕤被曝猥褻上海戲劇學院畢業(yè)生。當事人A女士于9月2日報案，上海市公安局松江分局7日給出立案告知書，目前田蕤已被逮捕。
