包括楊倩、陳夢(mèng)和全紅嬋在內(nèi)的奧運(yùn)健兒姓名被搶注商標(biāo)，種類涉及酒水、運(yùn)動(dòng)裝備、培訓(xùn)行業(yè)等。據(jù)報(bào)道，跟跳水冠軍“全紅嬋”相關(guān)的商標(biāo)，至少有19個(gè)，另有數(shù)十個(gè)全紅嬋昵稱“杏哥”被搶注；還有不少跟射擊冠軍“楊倩”相關(guān)的酒水產(chǎn)品商標(biāo)等。

Several Chinese star athletes including Yang Qian, Chen Meng, and Quan Hongchan saw their names registered as trademarks in various categories, including alcohol, sportswear, and tutoring industries, following their success at the Tokyo Olympics.

There were at least 19 trademark applications related to the name of 14-year-old Quan Hongchan, who won Olympic gold in the women's 10m platform, in just one week after the Tokyo Games, according to media reports. Even nicknames of Quan Hongchan - "Xing ge" were also registered for at least 50 categories. Yang Qian, who won China's first gold medal at Tokyo 2020 with her victory in the women's 10m air rifle, also saw her name registered as a trademark for alcohol and wares.

The Chinese Olympic Committee (COC) vowed on Wednesday to help protect Chinese Olympians against the illegal use of their names as trademarks.
 


中國(guó)奧委會(huì)表示：社會(huì)各界開展相關(guān)商業(yè)活動(dòng)，應(yīng)當(dāng)保持理性，切實(shí)尊重運(yùn)動(dòng)員合法權(quán)益，遵守《中華人民共和國(guó)民法典》《中華人民共和國(guó)商標(biāo)法》《中華人民共和國(guó)反不正當(dāng)競(jìng)爭(zhēng)法》等相關(guān)法律法規(guī)規(guī)定，如未獲得運(yùn)動(dòng)員本人或未成年運(yùn)動(dòng)員監(jiān)護(hù)人授權(quán)，不得以奧運(yùn)健兒姓名惡意搶注商標(biāo)或其他侵犯運(yùn)動(dòng)員姓名權(quán)等合法權(quán)益的行為；有上述行為的，應(yīng)及時(shí)撤回和停止實(shí)施商標(biāo)注冊(cè)申請(qǐng)。
 
"The COC wants to remind all that business activities should be conducted in a rational manner and in accordance with the relevant laws. The legitimate rights and interests of athletes must be respected," read a COC statement.

"Any registration of athletes' names as trademarks without the authorization of athletes themselves or their guardians is forbidden. Any offenders must stop their action."

運(yùn)動(dòng)員及未成年運(yùn)動(dòng)員監(jiān)護(hù)人有依法追究相關(guān)侵權(quán)行為人法律責(zé)任的權(quán)利。

"The athletes and the guardians of underage athletes have the rights to pursue the liability of relevant parties," added the statement.

對(duì)于奧運(yùn)健兒被搶注商標(biāo)，網(wǎng)友呼吁保護(hù)運(yùn)動(dòng)員合法權(quán)益：


據(jù)央視財(cái)經(jīng)報(bào)道，根據(jù)國(guó)家市場(chǎng)監(jiān)督管理總局發(fā)布的《規(guī)范商標(biāo)申請(qǐng)注冊(cè)行為若干規(guī)定》，對(duì)惡意進(jìn)行商標(biāo)注冊(cè)的申請(qǐng)人或商標(biāo)代理機(jī)構(gòu)，根據(jù)情節(jié)給予警告、罰款等行政處罰；構(gòu)成犯罪的，會(huì)依法追究刑事責(zé)任。

According to provisions of trademark registrations issued by State Administration for Market Regulation, those applicants or trademark agencies that have applied for trademarks out of malicious intentions will be given warnings and fines. Trademark agencies that have committed a crime will be investigated for criminal responsibility.
