12月26日，國家市場(chǎng)監(jiān)督管理總局宣布，依法對(duì)知網(wǎng)濫用市場(chǎng)支配地位行為作出行政處罰并責(zé)令其全面整改。

根據(jù)《反壟斷法》第五十七條、第五十九條規(guī)定，綜合考慮知網(wǎng)違法行為的性質(zhì)、程度、持續(xù)時(shí)間和消除違法行為后果的情況等因素，2022年12月26日，市場(chǎng)監(jiān)管總局依法作出行政處罰決定，責(zé)令知網(wǎng)停止違法行為，并處以其2021年中國境內(nèi)銷售額17.52億元5%的罰款，計(jì)8760萬元。
 

Domestic online academic database China National Knowledge Infrastructure (CNKI) has been fined for monopolistic behavior, the country's top market regulator said on Monday. The State Administration for Market Regulation has imposed a fine of 87.6 million yuan on the platform, a figure equal to 5 percent of its 2021 domestic sales, the regulator said in a statement.

 

經(jīng)查，知網(wǎng)在中國境內(nèi)中文學(xué)術(shù)文獻(xiàn)網(wǎng)絡(luò)數(shù)據(jù)庫服務(wù)市場(chǎng)具有支配地位。2014年以來，知網(wǎng)濫用該支配地位實(shí)施壟斷行為。
 

一是通過連續(xù)大幅提高服務(wù)價(jià)格、拆分?jǐn)?shù)據(jù)庫變相漲價(jià)等方式，實(shí)施了以不公平的高價(jià)銷售其數(shù)據(jù)庫服務(wù)的行為；
 

二是通過簽訂獨(dú)家合作協(xié)議等方式，限定學(xué)術(shù)期刊出版單位、高校不得向任何第三方授權(quán)使用學(xué)術(shù)期刊、博碩士學(xué)位論文等學(xué)術(shù)文獻(xiàn)數(shù)據(jù)，并采取多種獎(jiǎng)懲措施保障獨(dú)家合作實(shí)施。
 

Since 2014, CNKI has abused its dominant position to sell its database services at unfairly high prices. It has also restricted academic journals and universities by signing exclusive cooperation agreements.

 

調(diào)查表明，知網(wǎng)實(shí)施不公平高價(jià)、限定交易行為排除、限制了中文學(xué)術(shù)文獻(xiàn)網(wǎng)絡(luò)數(shù)據(jù)庫服務(wù)市場(chǎng)競(jìng)爭(zhēng)，侵害了用戶合法權(quán)益，影響了相關(guān)市場(chǎng)創(chuàng)新發(fā)展和學(xué)術(shù)交流傳播，構(gòu)成《反壟斷法》第二十二條第一款第（一）項(xiàng)、第（四）項(xiàng)禁止的“以不公平的高價(jià)銷售商品”和“沒有正當(dāng)理由，限定交易相對(duì)人只能與其進(jìn)行交易”的濫用市場(chǎng)支配地位行為。
 

Such behaviors have impeded competition within China's academic database service market, infringed on the legitimate rights and interests of users, and affected the innovation and development of related markets and academic exchanges, the market regulator said.
 

同時(shí)，市場(chǎng)監(jiān)管總局堅(jiān)持依法規(guī)范和促進(jìn)發(fā)展并重，監(jiān)督知網(wǎng)全面落實(shí)整改措施、消除違法行為后果，要求知網(wǎng)圍繞解除獨(dú)家合作、減輕用戶負(fù)擔(dān)、加強(qiáng)內(nèi)部合規(guī)管理等方面進(jìn)行全面整改，促進(jìn)行業(yè)規(guī)范健康創(chuàng)新發(fā)展。
 

It urged CNKI to correct its wrongdoings and make comprehensive reforms to its internal compliance structure, among other areas, to facilitate the industry's well-regulated, healthy and innovative development.

In a posting on its WeChat account on Monday, CNKI said it earnestly accepted and resolutely obeyed the SAMR decision.
 

同時(shí)，知網(wǎng)表示，“按照行政處罰決定，結(jié)合社會(huì)各方面的意見和建議，知網(wǎng)制定了以下五個(gè)方面共15項(xiàng)整改措施，現(xiàn)對(duì)外公開，接受各方監(jiān)督。”
 

方案中的15項(xiàng)措施包括，“解除獨(dú)家合作協(xié)議”，“降低銷售價(jià)格”，“保護(hù)作者合法權(quán)益”，“健全合規(guī)管理體系”及“加強(qiáng)合規(guī)風(fēng)險(xiǎn)管理”等內(nèi)容。
